Wisconsin gays face jail if they marry in California

If same-sex couples from Wisconsin go to California to get married, they may face a $10,000 fine, 9 months in jail, or both.

"Wisconsin law makes it a criminal offense to enter into a marriage outside the state if that marriage were illegal in Wisconsin. The law was passed decades ago to prevent underage couples from crossing state lines to marry, but it could be used against same-sex couples, Glenn Carlson of Fair Wisconsin told The Capital Times newspaper in Madison."

Wisconsin voters approved a constitutional amendment banning same-sex marriage in 2006.

While no one has been prosecuted under the law, Lambda Legal (the gay and lesbian legal association that fights for equal rights) posted a warning to Wisconsin residents on their website http://www.lambdalegal.org/publications/factsheets/fs_m...

Other states, including Delaware have laws prohibiting residents from circumventing state law by traveling to another state, but Wisconsin's punishment is the harshest.

  • they don't have authority over what can and cannot be done outside of their state, they rule over the land, not over people's lives

    i think that these laws that try to control what goes on other states are ridiculous, and the federal government should probably prohibit them

  • I think it's funny that people are all for a State to pull rank and do their own thing with allowing the gay marriage but then when another state decides that they will not agree with another state's law people have a fit.

    It's the same line of thinking used in a way that goes against what you want, but it's no different than allowing it because they are a State that is not waiting for the government.

    Either it's okay for a State to make their own laws about this or it's not. It cannot be alright just because the law is appealing to your wants and needs.

  • We have courts in part, to protect minorities from the majority. The founding fathers were correctly wary of mob rule. Just because Wisconsin voters supported discrimination, it does not make them right.

    Cases like this will emerge over and over again as the California supreme court decision ripples through our society. Eventually the Supreme Court will way in, and hopefully side with equality for all, including gay people.

    Part of my happiness includes being treated with respect under the law and not being arrested for marrying my partner. I have a right to happiness in this country I and I will fight for it every day.

    Freedom extends beyond spatial bounds. Freedom to marry is beyond the state's choice, beyond the people's choice, it is guaranteed by our Federal Constitution.

    all we need is one person (well.....uh....couple) to do it and bring on some huge lawsuit. Sure it would suck if they lost, but be cool if they won.

  • Idaho has a law on the books that bans sex in any position other than the 'missionary' position, specifically to ban two men from having sex. What these two laws have in common is that they are practically impossible to enforce.

  • "I think its funny how" some people rationalize the fact that they are telling other american's, the same people our soldiers are "dying to protect", that basically they are immoral, evil people and they should be punished for living and loving those they choose.

    Not to get heated, but I believe the Nazi's held the same idealism of unity (purity of mind and body), of everyone believing and being the same. thankfully we've outlawed bigotry against religion and race after hundreds of years of effort and suffering (even though it still runs rampant through most of the nation) and still there are people who will badger on about how people are going to lead to the moral downfall of society for who they are born as, just like letting the irish come over, or women vote, or blacks have equality was going to lead to the downfall of society.

    what hurts me is why people never learn. we in america are lucky to have relatively open access to the atrocities of our past and yet there are still "jjammer's" out there who blabber on about states rights while people are being subjugated by laws and forced to live according to the whims of ignorant masses who barely understand or could argue their viewpoints. enforcing a law such as this is no better than the nazis jailing people for being born jewish (or gypsy, gay, invalid, whathaveyou). However you want to try to slice it, however you want to try to moralize or legalize it, it's still people sanctimoniously telling other what is and isn't ok in their private lives (and then of course jailing them for it).

    america was founded on a better ideal than that, in fact it was founded on the exact opposite ideal to that.

  • please leave Latinos and African Americans and especially Rosa Parks out of this , she would not support gay marriage and neither does the black church or Latino Catholic church trust me I know.. keep them out of this subject ....this gay situation is Totally different I could not care one way or the other..I dont think they should jail gays for marrying that is between them and God, But like the Blacks and Latinos fought for civil rights..the gay struggle is thier OWN struggle. Born that way who knows...but you cant choose to be black..who chooses unemployment, poverty, black on black crime, high blood pressure, diabetes, NYPD,LAPD...all PD...if your still white hell ya got that going for ya. The gay thing is totally different. I dont have anything against them like others do but I dont like people piggy backing on civil rights my ancestors fought fur while others hid in the closet with mommy and daddy's inheritance.. I wish the gay rights struggle the best of luck. Trust me though Blacks and Latinos want to be left out of it PERIOD..ask my 74 year old father.

  • I think this issue should have one resolution all together to stop this state issue precedence with gay marriage...but I will bet you no politician will touch it. I don't blame them...I think every one has a right to their own lifestyle and I know gay people who are cool with me. Even they don't like how gays jump on civil rights (they are black and latino and they say other gays DON'T stick up for them and they in turn have their own communities) and they don't think any politician will deal with this issue. Regardless of my personal spiritual beleif I think people have a right to do what they want to do and people acting like this is leading to pedaphilia are stupid.

  • This law is just crazy and very wrong. I think that all of the gay rights organizations at the local, state and federal levels should all file law suits aganst the state of Wisconsin. They would take notice of 500 or 1000 law siuts. Not to mention the fact that the state would be tied up in court for years to come. That may make them rethink their position on gay marriage

  • Listen up my homo brothas! Why do we need to be accepted by anyone to be happy? Why do we need a marriage certificate? We should be fighting for equal rights... let's not try to encroach on something that these stuffy ass conservative pieces of shits take so personally, like marriage.

    Let's give them marriage and just ask that we be able to write whomever we want into our wills, that we can have whomever we like at our bedside should we ever have the unfortunate event of being at the hospital, let's ask for the ability to sign off on important documents as long as we are stated to be able to do so by that person, regardless of the relationship.

    I say we let all those conservative bastards have their marriage and their certificate, and I'll keep on truckin' and fuckin' my boyfriend, and won't give a shit who knows or cares. I will live my life and make sure when and if the time comes, that my boy is respected and treated as my partner in life and crime. We do everything together and anything life throws our way, we handle it together. And I'll be damned if someoe tries to belittle that relationship or say it doesn't stand up to theirs ('cause they're straight).

    I don't need anyone to acknowledge it as "legit" or "real", but I do expect them to respect our relationship when I need it the most and it means the most to me (whether in the hospital, whether I die, or am in jail, or want to buy a house, etc). We just want to live our lives together, and not be bothered or treated differently based on the fact that we are of the same sex. And that applies to my rights, and our rights as a couple. I don't need marriage, I just need to know I'm gonna be treated fairly when and where it counts. All the other shit is just a trifling distraction.

  • The volatility of this subject never ceases to amaze me. There is such hatred of homosexuals in this country. We can argue the application of law to each respective state, but any law, or law that supports the removal of rights for any group in our country needs to be fought. I have heard many an argument as to why our homosexual brethren should not be able to marry, but most of these meanderings are not based on anything but personal opinion and limited religious reasoning, both of which, surprisingly still over-rule our Constitution when it says all are created equal, and all are entitled to Life, Liberty and the pursuit of Happiness. So, I can't support any law that strengthens the idea of taking away someone's rights based on a criteria i.e. the Bible, that we, as a people can't even a agree on. Are full rights limited to Christians? Ideally, they shouldn't be, but it seems this is the direction we are going in...

  • uroburos you just further proved my point with you last comment about jews helping in the civil rights struggle (my best friend is a jew who never admits he is a jew he says white gays do it also, I woulnt know we cant work there with our education). Now look at jews who fought for civil rights after they got what they wanted they left blacks and latinos to their own fight. This is why I dont like when gays try to piggy back on civil rights...then what? I know Black and gay Latino people in the hood that say the white gay community ignores them and half of them except when they want a "exotic beauty" . Civil Rights should be left alone for people that actually really need it and not a trend to be jumped on. One bastard that hated you and I both just DIED TODAY that jumped all over civil rights! Notice he never tried to stop gays from voting (that weren't people of color).

I also learn from Gandhi, Howard Zinn, the Dalia Llama, and many others. We all have the same goal, to find justice in unjust situations.
